a Tag which you can't select is a broken tab.
it should always be hidden (and not as an option) if the viewer buffer is empty.

Ok, but when it does all what you want why you want to get away from it? it doesn't. Well You certainly have my vote against this.

I don't understand how you can possibly request such thing for a image viewer.

take a few steps back, think again, and go ask your file manager developer to more tightly integrate image files

indeed this will break your thumb grid.
but this behavior could certainly be applied by default in any filmstrip like view.
