Legal to implement patented algorithms in XnView?

Supposedly France does not legalize software patents, which is apparently why VLC itself exists.


Basically I've discovered an I-swear-it's-freakin-magical upscaling algorithm (S-Spline Max), but sadly it is patented. However, I'm pretty sure they're illegal in France, so does that mean it would be legal for something like VLC or XnView to legally and freely create their own implementation of it?
