Description: when in browser mode the histogram cannot be hidden.
View -> Info Panels -> Histogram
Toggling this has no affect at all on visibility. 'H' key has no affect except in Fullscreen mode - 'H' toggles as it should.
There is absolutely no way to get rid of the histogram unless you are in layout mode 'Free', then I can click the 'x' and it goes away.
Not sure this is a bug or if it's a design 'feature'.

What you're experiencing is not a bug. It's just your lack of familiarity with the software. I'll try and shed some light on this for you...
(In the future, please only post in the Bug Reports board if you're SURE you have found a bug).
You're mistaken about the shortcut key and the lack of another way to show/hide the histogram. The application is not well documented at all, and there are many options, so it is common for new users to be confused by things like this.
First, the histogram shortcut key does not work in the Browser. In fact, there is no shortcut key in the Browser to show/hide the histogram. Showing/Hiding the histogram (overlay) via a shortcut key is only available in the viewer tab. If you look in Tools->Settings:Interface:Shortcuts, you will see there is a menu to select Browser shortcuts or Viewer shortcuts; they are configured separately. When you use that shortcut key in the viewer, you are showing/hiding the "Histogram Overlay". That's a different user interface element from the Histogram in the browser.
Second, there are TWO ways to show/hide the Histogram in Browser mode. (It is in fact possible to show two histograms simultaneously in the Browser.) You are evidently only partially aware of one...
#1: The View->Info Panels->Histogram function you are mentioning shows/hides the histogram as a tab inside the Info Panel. The Info Panel is the area where you see tabs for Properties, EXIF, XMP, Exiftool, etc. (Unless you have turned off the "Use Tabs" option in View->Info Panels, and then you will see no tabs at all).
You are probably looking at the main Histogram panel, which is not controlled by View->Info Panels->Histogram.
Now, to (temporarily) make your life a little easier, select View->Panels->Show Title of Panels (enable). You will see "titlebars" for all the various panels. You can do this is ANY layout, not just "Layout Free". These titlebars have the x on them to close individual panels.
#2: And if you right-click on any of these titlebars, or on the main toolbar, or on the main menubar, you will see a menu with many things; that menu shows all the different panels and toolbars you can show/hide. Histogram is one of them. That's how you can turn the main histogram panel on or off. It would be nice if the Histogram were listed on View->Panels (which is separate from View->Info Panels) but it's not. So use the right-click menu as described.
Layout Free mode is not necessary for this. You can customize ANY of the layouts. By showing the Titlebars for the panels (as I taught you above) you can move/close/show/rearrange the panels in any of the layouts. You can save/restore layout presets, using the cmd_layoutM toolbar button (look for it in Tools->Settings:Interface:Toolbar and add it to your toolbar).
